Modify from DM 29 August 2017, n. 4969 “National strategy for the recognition and control of fruit and vegetable producer organizations and their associations, of operating funds and operational programs, for the period 2018-2022”
GIVEN the regulation (EU) n. 1308/2013 of the European Parliament and of the Council, of 17 December 2013, as amended by the regulation (EU) 2017/2393 of the European Parliament and of the Council, of 13 December 2017, establishing a common organization of the markets in agricultural products, which repeals the regulations (CEE) n. 922/72, (CEE) n. 234/79, (CE) n. 1037/2001 e (CE) n. 1234/2007 of the Council;
GIVEN the delegated regulation (EU) 2017/891 of the Commission, of 13 march 2017, supplementing the regulation (EU) n. 1308/2013 of the European Parliament and of the Council as regards the fruit and vegetables and processed fruit and vegetables sectors, complements the regulation (EU) n. 1306/2013 of the European Parliament and of the Council as regards the sanctions to be applied in these areas and amends the implementing regulation (EU) n. 543/2011 of the Commission;
GIVEN the delegated regulation (EU) 2021/652 of the Commission, of 10 February 2021, amending the delegated regulation (EU) 2017/891, as regards the activities and operational programs of producer organizations in the fruit and vegetables sector, and in particular the point 3 of the article 1 which states that “Member States may decide to extend their national strategy until 31 December 2025 ";
GIVEN the regulation (EU) 2021/2115 of the European Parliament and of the Council of 2 December 2021 laying down rules on support for strategic plans that Member States must draw up under the common agricultural policy (strategic plans of the CAP) and financed by the European Agricultural Guarantee Fund (UGLY) and the European Agricultural Fund for Rural Development (FEASR) and repealing the regulations (EU) n. 1305/2013 e (EU) n. 1307/2013;
GIVEN the delegated regulation (EU) 2022/126 of the Commission of 7 December 2021 supplementing the regulation (EU) 2021/2115 of the European Parliament and of the Council with additional requirements for certain types of intervention specified by Member States in their CAP strategic plans for the period from 2023 al 2027 under this regulation, as well as for the norms relating to the percentage for the norm 1 in terms of good agricultural and environmental conditions (BCAA);
GIVEN the decree of the Minister of Agricultural, Food and Forestry Policies 29 August 2017, n. 4969, con il quale è stata adottata la Strategia nazionale in materia di riconoscimento e controllo delle organizzazioni di produttori ortofrutticoli e loro associazioni, of operating funds and operational programs, modificata da ultimo con il decreto del Ministro delle politiche agricole alimentari e forestali 23 July 2021, n. 339387, per il periodo 1° gennaio 2018-31 December 2022;
VISTO l’atto di intesa n. 111/CSR dell’8 luglio 2021 della Conferenza Permanente per i rapporti tra lo Stato, le Regioni e le Province autonome di Trento e di Bolzano, which establishes the agreement on the draft decree relating to national provisions on the recognition and control of fruit and vegetable producer organizations and their associations, of operational funds and operational programs and "takes note of the commitment of the MIPAAF for a subsequent in-depth analysis with the European Commission on the actual implications of the extension of the current Strategy to 2025";
